Welcome to The Happy Lil Bakery! These Terms & Conditions (“Terms”) govern your use of our website and your purchase of products from The Happy Lil Bakery (“we,” “us,” “our,” or “The Happy Lil Bakery”).
By using our website, submitting an order, or purchasing our products, you agree to these Terms. Please read them carefully before placing an order.
1. About The Happy Lil Bakery
The Happy Lil Bakery is a home-based bakery located in Missouri. We specialize in homemade baked goods prepared in a home kitchen.
Our products are made in accordance with applicable Missouri cottage-food requirements. Certain baked goods produced under Missouri's cottage-food law are not prepared in a kitchen subject to routine inspection by the Missouri Department of Health and Senior Services or a local health department.
Where applicable, our product labels will contain the disclosures required by Missouri law.
2. Who May Use Our Website
You must be legally capable of entering into a binding agreement to place an order through our website.
By using this website or placing an order, you represent that the information you provide is accurate and that you have the authority to make the purchase.
We reserve the right to refuse or cancel an order if we believe there has been an error, fraudulent activity, misuse of the website, or a violation of these Terms.
3. Products and Availability
We make our products in small batches, and availability may vary.
Product photographs are provided for illustrative purposes. Because our products are handmade, individual items may have minor variations in color, size, shape, decoration, or appearance.
We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice.
If a product becomes unavailable after you have placed an order, we will contact you regarding an appropriate replacement, revised order, or refund, as applicable.
4. Custom Orders
Custom cakes, cookies, decorated desserts, and other personalized products may require additional information from you, including preferred flavors, colors, themes, wording, dates, quantities, and design preferences.
Because custom products are made specifically for you, changes to a custom order may not be possible after production has begun.
We will make reasonable efforts to follow your requested design. However, handmade and artistic products may not be an exact replica of a reference photograph, drawing, or previous order.
Submitting an inspiration photograph or design reference gives The Happy Lil Bakery permission to use that image solely as a reference for creating your order. We do not claim ownership of designs or artwork created by other people.
5. Orders and Order Acceptance
Submitting an order through our website does not necessarily mean that the order has been accepted.
An order is considered accepted when The Happy Lil Bakery confirms the order and payment requirements have been satisfied.
We reserve the right to decline or cancel an order for reasons including, but not limited to:
Product availability
Scheduling or production limitations
Incorrect pricing or website errors
Inability to verify payment
Requests that cannot reasonably be fulfilled
Suspected fraudulent activity
Failure to provide information necessary to complete the order
If we cancel an order after payment has been received, we will provide an appropriate refund for the canceled portion of the order.
6. Pricing and Payment
All prices are listed in U.S. dollars unless otherwise stated.
Applicable taxes, fees, or other charges will be displayed at checkout or communicated to you before your order is finalized, when applicable.
We accept the payment methods displayed on our website at the time of purchase.
Prices are subject to change at any time. A price change will not affect an order that has already been confirmed and paid for unless otherwise agreed.
7. Deposits and Payments for Custom Orders
For custom orders, a deposit or full payment may be required before the order is considered confirmed.
Any deposit requirements, remaining balance, and payment deadlines will be communicated to you before your order is finalized.
Failure to make a required payment by the stated deadline may result in cancellation of the order and forfeiture of any applicable deposit, subject to applicable law and the specific terms communicated at the time of purchase.
8. Cancellations and Refunds
Because our products are often made specifically for individual customers, cancellation and refund eligibility may depend on when the cancellation is requested and whether preparation of the order has begun.
Our cancellation policy is:
We ask for payment in full to secure your order. Our work begins as soon as payment is received. If you need to cancel your order more than 2 weeks before your scheduled pickup or delivery, you will receive a refund except for $25, which covers the work we started as soon as we received payment. Between 1 and 2 weeks before your scheduled pickup or delivery: You will receive a 50% refund of the total order. Less than 1 week before your scheduled pickup or delivery, no refund will be issued, as your order is already in production.
Once production has begun, custom or personalized orders may not be eligible for cancellation or refund.
If you receive an order that is incorrect, damaged, or has another significant issue, please contact us as soon as reasonably possible so that we can review the situation and determine an appropriate resolution.
Nothing in these Terms is intended to limit any rights you may have under applicable law.
9. Pickup and Delivery
Orders will be available for pickup or delivery according to the arrangements provided at the time of purchase.
Pickup location: If you would like to pick up the location for pickup is around the area of O'Fallon, Mo.
If you would like the cookies delivered there is a $30 fee. Anything over an hour drive from my location is subject to a higher charge.
Because The Happy Lil Bakery operates from a private residence, the exact residential address should only be provided to customers when necessary for an order pickup and should not be published publicly on the website.
Customers are responsible for arriving during the agreed-upon pickup window.
If you are unable to pick up your order at the agreed-upon time, please contact us as soon as possible.
Once an order has been picked up or delivered, the customer is responsible for proper handling, transportation, storage, and care of the products.
10. Food Allergies and Dietary Restrictions
Please read this section carefully before ordering.
Our products may contain or come into contact with common allergens, including but not limited to:
-Wheat
-Eggs
-Milk
-Soy
-Peanuts
-Tree nuts
Other ingredients that may cause allergic reactions
Because our products are prepared in a home kitchen, we cannot guarantee that any product is completely free from allergens or cross-contact with allergens.
If you have a food allergy or dietary restriction, please contact us before placing your order. We will provide available ingredient and allergen information to the best of our ability.
Customers are responsible for informing The Happy Lil Bakery of any allergies or dietary restrictions before an order is prepared.
The Happy Lil Bakery cannot guarantee an allergen-free product.
11. Product Storage and Handling
Customers are responsible for following any storage and handling instructions provided with their order.
Some products may require refrigeration or other specific storage conditions.
The Happy Lil Bakery is not responsible for damage, spoilage, melting, contamination, or other changes to a product resulting from improper transportation, storage, handling, or environmental conditions after the order has been picked up or delivered.

You agree to use this website only for lawful purposes.
You may not:

We reserve the right to restrict or terminate access to the website for users who violate these Terms.

14. Customer Photos and Reviews
